A federal lawsuit was filed Thursday to block reform on national healthcare, claiming that it infringes on the rights of a Tempe, Arizona business owner, Arizona lawmakers, and members of Congress.
In the lawsuit, the health care reform plan is accused of taking away individual rights and stating that Congress couldn’t have the authority to conduct proper oversight of the system. The lawsuit also claims that the health care reform plan violates the First Amendment rights of Arizona lawmakers.
Clink Bolick, attorney for the Goldwater Institute, says, “We believe that the lawsuit that we filed this morning is the strongest challenge yet to the federal health care law.”
The Goldwater Institute is a Phoenix based law firm, representing the lead plaintiff, Nick Coons. Coons is the owner of RedSeven, a computer repair company. His suit claims he carries only catastrophic insurance coverage in order to save money, and also based on his good health. His plan covers about $5,000 while Coons pays for the other medical care himself.
Coons claims that the money he saves helps him invest and grow his business. The idea of being forced into paying for medical coverage he probably wont need is an outrage. Even more upsetting to him is that he could face fines starting in 2014 if he hasn’t bought a federally approved health plan.
Bolick, of the Goldwater Institute, claims all of this violates First Amendment rights as well as the ability of lawmakers to properly act on behalf of those they represent. Bolick adds, “We believe this amounts to coercion.”
All lawmakers involved in the suit, Sen. Chuck Gray and Reps. Cecil Ash, Andy Biggs, Steve Court, Laurin Hendrix and Warde Nichols are all Republicans.
